That's how it should be with gas engines too, since a 50cc engine can have anywhere form 1/4 to 8 horsepower.
Usually anything under 500 watts is considered not to need registration !.

I am looking at a new Gio e-scooter, 500watt electric moped. It is limited to 32kph, because of provincial law, etc. Is there an actual limiter or governor on it? Can the speed be increased?

No. All the wiring, motor etc on that scooter is rated for 500 watts, no more.
